Mediation is a confidential out-of-court process where a neutral third party helps facilitate an agreement between the parties. I offer two kinds of mediation services--Domestic Relations Mediation and Civil Mediation.
Domestic Relations Mediation or Family Mediation focuses on topics surrounding divorce, custody, and parenting time.
Civil Mediaton focuses on settling disputes on a variety of topics in civil law (i.e. not criminal). This could include issues in tort law, contract law, or property law to name a few.
Unlike the often long and costly process of litigation--mediation is a confidential, cost-effective, efficient, and non-adversarial alternative that allows the parties to better control the outcome of their disputes. At the end of a trial, a Judge will typically determine the outcome of the case for you--mediation puts the control of the outcome of the case in the parties' hands.
The process of litigation as a whole will often take months or even years to complete and the cost can reach tens of thousands of dollars after Court costs and lawyers fees. Even after all of that--a Court can still decide against you.
The process of mediation allows parties to develop creative solutions to their disputes without the Court's intervention. The parties are in complete control of the outcome of their case. Even if mediation is not successful and the parties choose to go to trial--mediation's confidential nature ensures the parties cannot use what was said in mediation against the other party.
In short, mediation is a very helpful tool that allows parties to find satisfactory solutions to disputes while avoiding the high costs and stress of the litigation process.
The Mediator is a third-party neutral whose goal is to help facilitate an agreement between the parties. A Mediator's job is to guide the settlement discussions while maintaining neutrality. While any settlement is completely voluntary--the Mediator will do their best to clear the way for the parties as they work toward a satisfactory solution.
Parenting Coordination is a child-focused method of conflict resolution that works with both parents to resolve parenting disputes and assists the parents in improving communication on issues related to their children.
A Parenting Coordinator is a certified, registered, and court-appointed individual who assists high-conflict parents by accessing and managing parenting disputes that may arise in the co-parenting relationship.
The Parenting Coordinator takes a child-focused and systematic approach to dispute resolution. This method redirects the focus of the dispute to the best interests of the child and develops solutions that will best meet that interest while educating the parties on how to best make these decisions themselves.
The goal of Parenting Coordination is to assist high-conflict parents to develop and utilize effective co-parenting techniques that focus on the best interest of the child. The Parenting Coordinator will make reasonable efforts to encourage the development of a healthy and effective co-parenting relationship.
A Parenting Coordinator's role and duties are usually spelled out in the Court's order appointing them. Depending on what level of authority they have they may even submit binding recommendations to the Court for approval or further hearing. Some of these duties include:
